Mediation

Mediation is an alternative dispute resolution process in which former spouses work with a trained mediator to reach mutually agreeable solutions — outside of court.

A Family Law Mediator is a family lawyer with specialized mediation training who guides the process, helping you identify your needs and concerns and develop your own solutions to conflicts arising from separation or co-parenting. Sessions typically involve you, your former spouse, and the mediator, and may also include your respective lawyers. Additional professionals — such as child specialists, financial experts, or business and pension valuators — can be brought in as needed. Mediation can run alongside an existing court proceeding as a way to avoid trial, or serve as a standalone process for those who have never been involved in the court system.

Compared to traditional litigation, mediation offers several meaningful advantages:

  • Lower costs
  • Faster resolution
  • More durable, long-lasting agreements
  • Solutions tailored to your unique circumstances
  • You make the decisions — not a judge

The process typically begins with intake forms and a pre-mediation meeting with each party to gather background information, clarify the key issues, and establish what a successful outcome might look like. Both parties are encouraged to seek independent legal advice beforehand to better understand their rights and obligations. Sessions are currently held via Zoom, allowing participants to engage from wherever they are. If an agreement is reached, it can be formalized in writing by either party’s lawyer or by the mediator. Mediation costs are generally shared equally between both parties.
